The Labour Hire Licensing Act 2017 (Qld) (the Act) will come into force on 16 April 2018. The Act requires that all labour hire providers in Queensland hold a licence and that if you are utilising the services of a labour hire provider, you must only hire workers from a licensed provider. Penalties for failing to comply can include fines of over $12,000.00 or imprisonment.
Labour hire providers have until 15 June 2018 to make an application for a licence. Licences are renewable every 12 months, which incur an annual fee and require reporting by the labour hire provider every six months on their workplace law compliance. If you hire from such labour providers, make sure you check the online register (when it is established) to ensure your provider is licenced to avoid a severe penalty.
